This right of access shall be stated explicitly in the contracts or agreements concluded to implement the instruments referred to in this Decision.

The European Commission shall report as soon as possible to the National Audit Office of Liechtenstein any fact or suspicion relating to an irregularity which has come to its notice in the course of the on the spot check or inspection.

The authorities of the Republic of Moldova shall also report on all measures taken in connection with facts communicated under this Article.

Under this Agreement, the Commission (OLAF) is authorised to carry out on the spot checks and inspections on Swiss territory, under the terms and conditions set out in Council Regulation (Euratom, EC) No 2185 96 of 11 November 1996 concerning on the spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities 3 .

Trade facilitation

The Parties are committed to effectively implementing the relevant international standards, in particular those enshrined in the UN Convention against Transnational Organised Crime (UNTOC) of 2000 and its three Protocols, and the UN Convention against Corruption of 2003.

In any event, the European Commission is required to inform the aforementioned authority of the result of such checks and inspections.

To that end, the officials of the competent Swiss authorities may participate in the on the spot checks and inspections.

The Swiss Federal Audit Office is to be informed in advance of audits conducted on Swiss territory.

In the case of sampling checks, the Parties shall ensure that they are representative through their number, type and frequency.
