Each Party to the dispute and its advisers shall treat as confidential any information submitted by the other Party to the dispute to the arbitration panel which that Party has designated as confidential.

No arbitrator or former arbitrator shall disclose at any time the deliberations of an arbitration panel, or any arbitrator's views.

LIST OF ARBITRATORS

The arbitration panel shall make every effort to take any decision by consensus.

arbitrator means a member of an arbitration panel established under Article 385 of this Agreement

Only the representatives and advisers of the Parties to the dispute may address the arbitration panel.

The arbitration panel may at any time during the proceedings address questions in writing to one or both Parties to the dispute.

The meetings of the arbitration panel shall be open to the public under the conditions laid down in the Rules of Procedure referred to in Article 18, unless the arbitration panel decides otherwise on its own motion or at the request of the Parties.

If any of the supporting documents is confidential or too big to be sent by e mail, the Party sending the document may provide that document in another electronic format to the other Party and, where relevant, to each of the arbitrators within one day of the delivery of the e mail.

If the Party complained against considers that the level of suspension is not equivalent to the adverse economic impact caused by the violation, it may request, in writing and before the expiry of the ten day period referred to in paragraph 2, that the chairperson of the original arbitration panel reconvene the original arbitration panel.

The ruling shall set out the findings of fact, the applicability of the relevant provisions of this Agreement and the reasoning behind any findings and conclusions that it makes.

Article 64

General provisions

The Partnership Committee shall make the report of the arbitration panel publicly available, subject to the protection of confidential information as provided for in the Rules of Procedure.

Secretaries

Any change of e mail addresses or other electronic communications shall be notified without delay to the other Party and the arbitration panel, where applicable.

Each of the parties to the dispute shall appoint an arbitrator and the two arbitrators so appointed shall designate by common agreement the third arbitrator who shall be the President of the tribunal.
