The FMC of the flag State shall inform the São Toméan FMC and the EU of the outcome of the measures taken within 24 hours of recognising the failure.

In the event of a breakdown in the on board ERS, the master and or owner shall ensure the ERS is repaired or replaced within ten days.

The relevant VMS data shall be sent immediately after the maintenance work has been completed.

Any changes to the contact details of the ERS correspondent must be notified immediately.

If the vessel makes a call at a port within those ten days, it may only resume fishing activity in the Liberian fishing zone once its ERS is in perfect working order, unless Liberia authorises otherwise.

Some emission related maintenance is also classified as critical emission related maintenance.

Centering and Tracking

Each Party shall establish, in accordance with this Article, a tracking and tracing system, controlled by the Party for all tobacco products that are manufactured in or imported onto its territory taking into account their own national or regional specific needs and available best practice.

Each Party shall endeavour to ensure that any discretionary legal powers under its domestic law relating to the prosecution of persons for the unlawful conduct, including criminal offences established in accordance with Article 14, are exercised to maximize the effectiveness of law enforcement measures in respect of such unlawful conduct including criminal offences, and with due regard to the need to deter the commission of such unlawful conduct including offences.
